I. PURPOSE

The purpose of this policy is to ensure that confidentiality of protected information is maintained for all The Mitchell Wade Salon clients, and to provide The Mitchell Wade Salon clients with notice of the salon services and/or sales.

II. DEFINITIONS

A. Protected Information means any information that is created or received by MitchellWade.com which identifies an individual and relates to the past, present or future salon services and/or sales of that individual.

B. Eligibility Information means information, whether written or oral, which describes a member or a member's eligibility for past or future salon services and/or sales. Financial responsibility for your account is yours.

III. SCOPE/POLICY

A. The Mitchell Wade Salon shall not disclose any information about a client collected or received in connection with a transaction unless the disclosure is permitted or required by law, and is

1. To the member or the member's legal representative or guardian, upon presentation to The Mitchell     Wade Salon of a valid picture ID; or

2. With the written authorization of the member, or the member's legal representative or guardian, provided the authorization is:

a. Dated;

b. Signed by the member or the member's legal guardian; and

c. Obtained one (1) year or less prior to the date a disclosure is sought; or

3. Made for the purpose of conducting actuarial or research studies, provided:

a. No member may be identified in any actuarial or research report;

b. Materials allowing the member to be identified are returned or destroyed as soon as they are no longer needed; or

4. To an internal or external professional peer review organization for the purpose of reviewing the service or conduct of a salon; or

5. In response to a facially valid administrative or judicial order, including a search warrant or subpoena; or

6. Otherwise permitted or required by law.

B. In addition to those circumstances described in Section III(A), Eligibility Information will be provided in the following circumstances where permitted or required by law:

1. To a member stylist or technician, a member, a member's current spouse, a member's eligible dependent, or the legal guardian of an eligible dependent, upon presentation to The Mitchell Wade Salon of a member's valid picture ID;

IV. PROCEDURE

1. All of The Mitchell Wade Salon employees, upon employment, agree to abide by The Mitchell Wade Salon policy and procedure of "Confidentiality of Information" which details the importance of confidentiality of personal information, and other materials. The consequence of violating this policy includes disciplinary action up to and including dismissal from employment.

2. Any client specific information will be considered confidential and will be shared only with those parties who have the authority to receive such information, as provided for in Section II, above.

3. If disclosure is required through a court order or subpoena, the order or subpoena will first be reviewed by The Mitchell Wade Salon Legal Department to determine the legitimacy of the order, the purpose for the disclosure, and limitations on the information disclosed.

4. System stored client specific personal information will be protected through system security measures designed to protect against access by unauthorized staff.

5. If The Mitchell Wade Salon becomes aware of a confidentiality violation by a employee member The Mitchell Wade Salon staff will determine the proper steps needed to restore confidentiality.

V. Confidentiality and Security on MitchellWade.com

The Mitchell Wade Salon respects the privacy of its Web site users. Simply by visiting The Mitchell Wade Salon Web site, personal information is not collected.
